Organizer

The organizer of the sweepstake is innovaphone AG. Further information on innovaphone AG can be found at https://www.innovaphone.com/en/imprint.html.

Participants and Conditions for Participating

Only natural persons of full age and full legal capacity who have declared their consent to these conditions of participation may participate in the sweepstake.

The user participates in the sweepstake by correctly answering the 4 questions for the sweepstake between March 8^th, 2021, and April 4^th, 2021, on the respective innovaphone promotional website. By participating in the sweepstake, the user simultaneously accepts the conditions of participation.

The closing date for entries to the 4 questions sweepstake is Sunday, April 4^th, 2021, at 23:59 (11:59 pm).

Participation is free of charge and not contingent on the purchase of goods or services. It is not permissible to participate more than once in the 4 questions sweepstake, meaning users are not permitted to register several accounts to participate in the 4 questions sweepstake in order to increase the chances of winning.

Exclusion from Participation

Participants who provide untrue personal details are excluded from participation. Further, participants who manipulate or try to manipulate the entry to the sweepstake and/or the drawing and/or violate these conditions of participation in any other way will also be excluded. The exclusion may also be issued in retrospect, in which case a demand will be issued to return any winnings.

How will the Sweepstake be Conducted and the Winner Notified?

The winner is drawn on a random basis and notified no later than two weeks after the entry period for the sweepstake has ended. The winner will be notified by innovaphone in writing via e-mail (“winner’s notification”); the claim to the prize arises only if the winner declares that it intends to accept the prize to innovaphone within a period of five calendar days from the day the winner’s notification is sent (“prize acceptance”). If the winner fails to declare acceptance of the prize within the specified period, a new winner will be drawn.

Prize

The prize per question is a package of innovaphone giveaways (consisting of a cuddly toy fish, a tin with peppermints, ballpoint pen, cup, a set of cards, 2021 calendar, computer mouse, face mask, gymsack, writing pad). The prize will be sent by mail.

The winner shall bear any cost not included therein or exceeding such cost. Prizes can only be delivered free of charge within the EU and any customs duties or higher delivery costs incurred in connection with a delivery abroad must be borne by the winner.

Depending on the availability, innovaphone AG reserves the right to replace the listed prize items with a prize that is of at least equal value.

Cash reimbursement of the prize is not possible. Claims to prizes cannot be transferred to other persons and cannot be exchanged for other items

Data Protection

In order to implement the sweepstake innovaphone AG collects personal data, i.e. the form of title, first name, surname, e-mail address and postal address.

All the personal data are collected, processed and used only for implementing and handling the 4 questions sweepstake. The data will not be used beyond this scope (point (b) of Art. 6 (1) GDPR) and will be erased after the 4 questions sweepstake is completed.

Premature Termination and Changes to the Sweepstake

innovaphone AG reserves the right to terminate or change the 4 questions sweepstake at any time without prior announcement if the proper implementation of the sweepstake cannot be guaranteed for technical or other reasons or if the fairness of the sweepstake seems compromised. This does not create any right to claim on the part of the participants.

Personality Rights in Connection with the Disclosure of Names and Usernames

The participant agrees that its name and username is disclosed in the scope of the sweepstake if the participant wins.

innovaphone AG’s Liability

Pursuant to this item, the following liability exclusions and limitations of liability apply to liability of the organizer for damages regardless of any other legal eligibility requirements.
The organizer is liable to an unlimited extent insofar as the cause of damage is based on intent or gross negligence.

In addition, the organizer shall be liable for slightly negligent breach of essential duties, the breach of which endangers the purpose of the contract, or for the violation of duties, the fulfilment of which would be necessary to carry out the 4 questions sweepstake properly and upon which the contractual partners may regularly rely. In this event, the organizer is only liable for foreseeable damage that is typical of such a contract. The organizer is not liable for the negligent breach of duties other than the duties referred to in the aforementioned sentences.

The above limitations of liability do not apply in case of injuries to life, limb or health, to defects following the issue of a guarantee regarding the quality and characteristics of a product and in case of fraudulent concealment of defects. Liability according to the German Product Liability Act (ProdHaftG) shall remain unaffected thereby.

As far as the organizer’s liability is excluded or limited, this also applies to the personal liability of the organizer’s employees, representatives and vicarious agents.

Others

The organizer is released from all obligations upon dispatching the prize, which also ends the 4 questions sweepstake, unless these provisions provide for the organizer being released from all obligations at an earlier point in time.

Any recourse to courts of law is excluded. Participants do not have a claim to the prize or the payment of the cash value of the prize that can be pursued in a court of law. The conditions of participation and the entire legal relationship between the participant and innovaphone AG are subject only to German law. If individual provisions hereunder are or become invalid, the validity of the other conditions of participation shall remain unaffected thereby.
