Conditions of Participation for the innovaphone Dialogs 2023

Section 1 Registration

Participants can register online for the Dialogs 2023 (hereinafter “Dialogs”) of innovaphone AG (hereinafter “Organizer”) by fully completing and submitting the registration form and confirming their e-mail address by clicking on the activation link (double-opt-in). Participants will then receive a registration confirmation via e-mail to the e-mail address provided in the registration form.

By submitting the registration form, participants accept and are bound by these Conditions of Participation. Participants can attend the Dialogs free of charge.

 

Section 2 Eligibility for Attendance

The Dialogs target only commercial customers (B2B) who do not classify as consumers within the meaning of Section 13 German Civil Code (BGB).

 

Section 3 Inability to Attend/Cancellation

If a participant is unable to attend despite being registered, the participant must inform the Organizer without delay, but no later than 48 hours before the event commences by sending an email to inside-sales@innovaphone.com.


Otherwise, the Organizer reserves the right to charge the participant a no-show fee of EUR 75 per person.

 

Section 4 Photographs, Drawings, Video Recordings

The Organizer is entitled to have photographs taken or drawings and video recordings made of the event, of participants and other people involved and to use such for advertising purposes and press releases.

The same applies to images or recordings that the press or television companies make directly with the Organizer’s consent.

 

Section 5 Liability

The Organizer is only liable to an unlimited extent in case of intent or gross negligence or for damage caused by injury to life, limb or health.

Otherwise, liability is excluded in cases of minor or ordinary negligence. This limitation of liability also applies to the conduct of the Organizer’s vicarious agents and persons employed by the Organizer for the performance of its contractual obligations.

Participants, in turn, are liable for any damages they culpably cause to persons or property.

 

Section 6 Rights of Use/Copyrights

The Organizer’s service offering, in particular, the services provided through speakers, for instance, speeches, PowerPoint presentations, video recordings, etc., are usually protected by trademark or copyrights.

Participants are not permitted to record, duplicate, disseminate or use the service offerings in any other commercial way unless both the Organizer and speaker or author concerned have expressly given their consent to such use.

 

Section 7 Organizer’s Rights as the Occupier of the Premises ("Hausrecht"), Violations

During the event, the participant agrees to abide by all the Organizer’s rights as the occupier of the premises. Participants must follow the instructions of the employees of these premises. Violations against the Conditions of Participation or against any instructions issued under the rights as the occupier of the premises entitle the Organizer to exclude participants from the event and remove them from the premises, unless the violations are discontinued after a corresponding request.

 

Section 8 Place of Performance and Jurisdiction

Sindelfingen, Germany, is the place of performance. The place of jurisdiction for all and any disputes arising from on in connection with the event is Stuttgart. Any exclusive place of jurisdiction takes priority.

 

Section 9 Data Privacy Information

The Organizer and, if required, service partners collect, process and use personal data for the purpose of taking care of and informing customers and prospective customers as well as for carrying out the offered services, thereby observing the provisions of the GDPR and any other relevant data privacy legislation. The Organizer’s data protection policy and transparency declaration applies. 


Section 10 Severability Clause

If parts of the Conditions of Participation are legally invalid or if they have gaps, this does not affect the validity of the remaining provisions or the contract. In this case, the parties undertake to replace the invalid provision or fill a gap with a provision that is best suited to achieve the economic purpose sought by the parties.
