Terms of Use for “Digital Solidarity with the innovaphone PBX” from innovaphone AG

§ 1 Scope of Applicability

Following conditions apply to the use of “Digital Solidarity with the innovaphone PBX” (subsequently referred to as “solidarity PBX”) from innovaphone AG (subsequently referred to as “provider”).

Using the solidarity PBX is only permissible if you accept the following conditions of use.

§ 2 Registration

1. Precondition for using this free version of the solidarity PBX is a registration via the link provided. Registration will be carried out per user. You will receive a confirmation e-mail after your registration for verification of your data. You can confirm your registration with this e-mail.

2. Contractual object is the free usage of the solidarity PBX from innovaphone AG. In order to register for the free version, you will have to state your first name, last name and your e-mail address. This information will be used to create your profile. Please note that your first and last names will be visible to all participants of the free version. This information is necessary so that all participants can communicate with each other. Your e-mail address is only required for the registration itself and will not be visible in your profile. The data must be retained to create a new password for an existing account, if necessary. Your e-mail address will be used solely for this purpose.

Optionally, every user has the opportunity to upload a profile picture. Please note that if you upload a picture, this will be visible to all other participants of the solidarity PBX. However, you can participate in the solidarity PBX and use all functions without uploading a profile picture.

3. The participant has the opportunity to delete the created profile at any time. Please note that not all data will be deleted. Posted messages (for example in the chat) remain unchanged and will not be deleted with the cancellation of the profile. If the participant does not agree to this procedure, the participant should refrain from submitting posts.

4. All data will be saved exclusively during the period of the solidarity PBX. After expiration of this free version, all saved profile data will be deleted. § 2 section 3 is also applicable in this case: posts and comments posted in the Chat app for example remain unchanged.

 5. Your account is supposed to be used solely by you. As the account holder, you are responsible for the protection against misuse or abuse. Your login details are to be protected from third party access.

6. The provider shall endeavor to offer the services for testing without any interruption. Even with all due care, downtimes cannot be excluded. The user recognizes that availability to 100% is not technically feasible.

The provider reserves the right to discontinue the free version at any time.

7. The provider reserves the right to change and / or expand the platform of the solidarity PBX with new contents. The provider will inform the users about the changes on the platform accordingly.

§ 3 Liabilities for the Participants of the Solidarity PBX from innovaphone AG

1. As the user, you commit yourself to not publishing any contributions that are against these rules, common decency or against the German Law in any way. You are specifically prohibited to:

• Post offending or false contents
• Send spam to other participants via the system
• Use legally protected contents without authorization, especially contents protected by copyrights and trademark rights
• Carry out anti-competitive activities
• Disperse advertisement without explicit authorization through the provider. This also applies to so-called surreptitious advertising. Specifically, the link to the own homepage with or without caption in the e-mail signature or within contributions is prohibited
• Hand over links and contact information of participants to third parties

2. The provider is authorized to block a user if there is sufficient reason to assume that these terms of use have been violated.

§ 4 Privacy Policies for Participants of “Digital Solidarity with the innovaphone PBX”

Following privacy policies apply for the purposes of the free solidarity PBX:

1. The data submitted for the registration (first name, last name, e-mail address) is only required to create your profile and will be saved exclusively for the duration of use.

2. Please note that your first and last name in your profile will be visible to all other participants of the service.

3. The participant has the opportunity to delete the created profile at any time. Please note that not all data will be deleted. Posts and comments posted in the chat for example remain unchanged and will not be deleted with deletion of the profile.

§ 5 Right of Revocation

Participation at solidarity PBX may be withdrawn by either party any time and without the stating of reasons. Profile data can be deleted by the participants themselves.
