Terms of Use for the innovaphone Community:

§ 1 Scope of Applicability

The following Terms of Use apply to the use of innovaphone Community on the myApps communication platform of innovaphone AG (hereinafter referred to as “innovaphone”).
By registering and using the myApps communication platform, the user accepts the following Terms of Use.

§ 2 Registration

2.1. Users must register via the link provided by innovaphone in order to use innovaphone Community. Each user must register personally. After registration, the user receives a confirmation e-mail to verify their data and to confirm their registration. Registration is only complete if the user clicks on the link provided in the confirmation e-mail.
2.2. The user account may only be used by the user. As the account holder, the user is responsible for protecting it against misuse. Login details must be protected against third-party access.
2.3. The user has no inherent right to being granted membership or permanent registration.
2.4. The registration link and the contact details of other users may not be passed on to third parties.

§ 3 Subject Matter of the Agreement

3.1. The subject matter of the agreement comprises the permission to use innovaphone Community functions, which innovaphone makes available free of charge to innovaphone Community users on the myApps communication platform. In order to register to innovaphone Community, users must input their first name, surname and e-mail address. This information is used to create the user profile. Special note for registered users: Please note that your first name and surname will be visible to all innovaphone Community users. This information is necessary so that all users can communicate with each other. Your e-mail address is only required for the registration itself and is not visible in your profile. The data must be retained in case a password for an existing account has to be renewed. Each user may upload a profile picture. Please note that once a picture is uploaded, it is visible to all other innovaphone Community users. However, it is also possible to use innovaphone Community without uploading a profile picture. Please note the innovaphone data protection provisions in § 6 with regard to data protection.
3.2. innovaphone endeavors to offer the platform services without interruption. Even with all due care, downtimes cannot be ruled out. The user has no legal claim for the service to be available constantly.
3.3. innovaphone assumes no guarantee that the content of its platform services is correct, complete, reliable, up-to-date and usable.

§ 4 Duties of the User

4.1. The user undertakes to refrain from posting any articles that violate these provisions, public morality or German law. In particular, the user undertakes to refrain from posting any contributions

• the publication of which constitutes a criminal offense or a breach of an administrative regulation;
• that violate copyright, trademark or competition laws;
• that include defamatory, racist, discriminating or pornographic content;
• that include advertising;
• that include spam;
• that include anti-competitive content;
• or that include untrue or false information.

4.2. innovaphone is entitled to block users if there is sufficient reason to assume that they have violated these Terms of Use and/or applicable law and/or third-party rights or if innovaphone has another legitimate interest that necessitates the blocking.
4.3. innovaphone reserves the right to delete contributions and content if these could include a legal violation against § 4.1
4.4. innovaphone may seek indemnification from the user for any third-party claims arising from that user’s violation of their rights. The user undertakes to support innovaphone in defending itself against such claims. The user is also obliged to cover the costs of reasonable legal representation for innovaphone.

§ 5 Copyright

5.1. The copyright for any contributions posted remains with the respective user.
5.2. innovaphone holds the copyright for all content that it publishes on its plat-form services. Reproduction, distribution or forwarding of content to third par-ties is not permitted without the express written consent of innovaphone. This applies to both commercial and non-commercial purposes.

§ 6 Privacy Policy

6.1 In the context of innovaphone Community and its online events and streams, the following data protection provisions and the data protection provisions of innovaphone AG (link) apply to the innovaphone myApps communication platform: https://www.innovaphone.com/en/privacy.html
Data transmitted for registration (first name, surname, e-mail address) are required to create your profile and are stored exclusively as long as innovaphone Community is used. Your e-mail address will only be used for this purpose.
6.2. Please note that your first name and surname as stated in your profile will be visible to all innovaphone Community users.
6.3. The user may choose to delete the profile at any time. Please note that not all data will be deleted. Posts and comments that are posted in the apps, for example, remain unchanged and are not deleted when the profile is deleted.
6.4. Personal data will not be disclosed to third parties.
6.5. In all other respects, the innovaphone data protection provisions apply.

§ 7 Amendment or Discontinuation

7.1. innovaphone is entitled to make changes to its platform services.
7.2. innovaphone is entitled to terminate its platform services at any time and without giving reasons. Users may cancel their participation in innovaphone Community and delete their profile at any time without stating a reason.

§ 8 Exclusion of Liability

8.1. Unless expressly stated otherwise in innovaphone’s General Terms and Conditions as amended, any liability of innovaphone, its representatives and vicarious agents is limited to willful or grossly negligent breaches of duty.
8.2. Claims from injury to life, limb or health are excluded from all exclusions and limitations of liability.
8.3. innovaphone accepts no liability for content that the user posts in innovaphone Community. If users upload content to innovaphone Community themselves, they are obliged to comply with all applicable statutory provisions at all times, in particular with regard to personal data, as well as all applicable data protection laws and other regulations and/or official requirements.

§ 9 Confidentiality

The employees of innovaphone are obliged to maintain confidentiality and to comply with the applicable data protection laws. innovaphone endeavors to take all necessary technical and organizational measures to ensure an appropriate level of protection and to safeguard user data collected by innovaphone in particular against the risks of unintentional or unlawful destruction, manipulation, loss, alteration or unauthorized disclosure or access.

§ 10 Choice of Law and Place of Jurisdiction

These Terms of Use and any resulting legal relationships are subject to the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction for any legal disputes arising from and in connection with these Terms of Use is Stuttgart (Germany). innovaphone is also entitled to take legal action before the competent court at the user’s registered office.
